Software Terms of Use

1. Object of the Software

Simule Agro is software that performs ONLY rural financing/credit simulations based on public information on credit lines available on official websites and other sources considered reliable.

Simule Agro DOES NOT offer loans, credit, financing, financial intermediation, or any other type of values of any nature. The software is informational and educational.

2. Non-Official Nature and Possible Inaccuracies

Simule Agro is not an official means of consultation. Conditions, interest rates, terms, and credit line limits may vary at any time and according to the user profile and/or financial institution policies.

Despite efforts to keep information updated, the software may present inaccuracies, errors, or be outdated. Simulations do not constitute a proposal, recommendation, guarantee of approval, or credit offer.

3. Forwarding to Partner Consultancy

In addition to simulations, the software may provide a shortcut for contact with a partner agricultural consultancy office, which may be changed without prior notice. Service, deadlines, costs, and results arising from this service are the sole responsibility of the partner.

4. Absence of Financial Relationship and Credit Responsibility

Simule Agro does not perform credit analysis, does not deliberate on financing concession or conditions, and has no influence on the decision of any financial institution. Any contracting must occur directly with the financial institution and/or consultancy hired by the user.

5. Limitation of Liability

To the maximum extent permitted by law, Simule Agro, its partners, administrators, and collaborators are not liable for direct, indirect, incidental, special, consequential damages, lost profits, loss of data, interruptions, or any losses resulting from the use or inability to use the software and its information. As well as for the contracting of services and/or purchase of products from partners.

The user acknowledges that any and all decisions made based on the software are their sole responsibility.

6. Appropriate Use and User Responsibilities

The user undertakes to: (i) use the software lawfully; (ii) provide true data when requested; (iii) not attempt to defraud, bypass, reverse engineer, or compromise the software's security; (iv) respect intellectual property rights.

7. Privacy and Data

Simule Agro may process data provided by the user to enable the software's operation and potential forwarding to partner consultancy. Processing practices will observe principles of necessity, purpose, and safety. Additional details may appear in a specific Privacy Policy.

8. Non-Configuration of Financial or Technical Advice

The information displayed by the software does not replace professional technical, legal, accounting, or financial evaluation. It is recommended that the user seek specialized consultancy for decision-making.

9. Changes and Service Availability

Simule Agro may, at any time, change, suspend, or discontinue features, content, and forwarding, without this generating any compensatory rights.

10. Advertising, Ads, and Consent (AdMob/UMP)

The app displays ads through Google AdMob, including formats such as banners and rewarded videos. Ad serving contributes to service maintenance and may influence the availability of certain features.

Consent: we use Google's User Messaging Platform (UMP) to collect and manage your advertising consent, where applicable. You can opt for personalized or non-personalized ads (NPA). Your choices may be stored and shared with ad technology providers solely for fulfilling informed purposes.

Data processed for advertising and measurement purposes: advertising identifiers (e.g., Advertising ID), IP address, device information, language, country/region, interactions with ads, and fraud prevention data. This data may be shared with Google and potential mediation partners only for ad delivery, measurement, and security, per Google policies.

Control and opt-out: you can adjust analytics preferences in the app settings, manage Google ad privacy choices in the app when the UMP flow requires it, and use device or Google ad settings where available.

Children and sensitive content: the app is not directed at children. In jurisdictions requiring specific treatment, personalized ads may be disabled by default.

Rewarded videos: certain features may require full viewing of an ad to unlock content (e.g., displaying simulation results). Display is subject to inventory availability and connectivity; reward may not be granted in case of interruption, technical failures, or early ad closure.

11. Subscriptions, Trial, and Billing (Google Play and/or App Store)

Premium is a renewable subscription via Google Play and/or App Store. A 7-day trial may be offered based on eligibility; if not canceled before the trial ends, billing starts automatically.

Cancellation, refund, and management occur in the store; Simule Agro does not refund directly. Price changes may occur with notice; continued use implies agreement.

Purchases can be restored on the same account. Inventory of rewarded ads may not be available; rewards dependent on them are not guaranteed.

12. Free and Premium Plans; Synchronization and Offline

Free: 1 gleba, with ads, no full offline, and no sync; some features may require rewarded ads.

Premium: multiple glebas, no ads, offline-first, sync/backup on Supabase (by user_id), and advanced features (exports, statistics, logo).

Downgrade: extra glebas are locked; data remains saved locally/remotely until reactivation or deletion. Make periodic exports.

Sync depends on connection; conflicts use LWW strategy. You keep credentials and devices secure.

Telemetry and crashes: we collect error/performance events (Crashlytics) with stack trace, model/OS, and event time, without capturing content you insert, to keep the app stable and secure.

13. Soil Correction and Fertilization Recommendations

Simule Agro offers soil correction and fertilization recommendation features based on the methodology adopted by INCAPER (Capixaba Institute of Research, Technical Assistance and Rural Extension).

Recommendations provided by the software are informational and educational, based on automated calculations and data entered by the user. Such recommendations DO NOT replace, under any circumstances, the monitoring and supervision of a qualified technical professional (agronomist, agricultural technician, or specialized consultant).

The user acknowledges that specific soil, climate, crop conditions, and other variables can significantly influence results, making technical validation by a qualified professional essential before applying any recommendation.

Recommendations generated by the software HAVE NOT been tested, validated, or verified in real field conditions, "in loco," or practical agricultural production environments. Calculations are purely theoretical and automated and may contain errors, inaccuracies, inconsistencies, or inadequacies for specific situations.

Simule Agro is NOT responsible for the use and application of recommendations provided by the software, the user being ENTIRELY responsible for such decisions and actions. Any practical application of recommendations must be preceded by analysis and validation by a qualified technical professional, considering the particularities of each property, soil, crop, and agronomic context.

14. Agro News - News Feeds

The app provides the "Agro News" section displaying news and information from the agricultural sector through RSS feeds from the following official sources: Canal Rural (canalrural.com.br), Agrolink (agrolink.com.br), Amanhã (amanha.com.br), and Globo Rural (globorural.globo.com).

Simule Agro acts exclusively as a content aggregator, displaying only titles, descriptions, and images of news, redirecting to original sources when the user clicks on content.

Displayed content does not necessarily express or reflect the opinion, position, or value judgment of Simule Agro. There is no curation, analysis, or editorial filter by Simule Agro in searching and displaying RSS feeds.

Simule Agro is not responsible for the veracity, accuracy, timeliness, or quality of news content, which is the sole responsibility of the original sources.

15. Regional Official Agricultural Integrations

Some features may consult official agricultural data providers available in the user's region. In Brazil, this may include EMBRAPA services such as Agrofit and RespondeAgro. These integrations are not available in every country or region.

The availability, creation, editing, updating, and maintenance of this information are the sole responsibility of the respective third-party provider. Simule Agro only consumes and displays such content without editorial modification, proprietary agronomic approval, or additional technical validation.

The user acknowledges that registrations, restrictions of use, dosages, questions, answers, and other technical data may be changed by the official provider at any time. Direct verification in official sources and validation by a qualified professional are recommended before any practical field decision.

16. Commodities Prices and Quotes

The app provides agricultural commodity quotes and prices through two main sources: (i) national prices provided by CEPEA (Center for Advanced Studies in Applied Economics) of ESALQ/USP, updated once a day; (ii) international commodity prices through the Alpha Vantage API.

Displayed quotes are provided by third parties and may present unexpected errors, delays, interruptions, or inaccuracies due to various factors, including but not limited to: network problems, database failures, temporary service unavailability, scheduled or unscheduled maintenance, and other factors beyond Simule Agro's competence and control.

Simule Agro does not guarantee the accuracy, completeness, or timeliness of displayed quotes, recommending direct consultation of official sources for critical decision-making information.

17. Gleba Mapping and Geolocation

Simule Agro offers gleba mapping features that may use user device geolocation data.

17.1 Mapping Features

  • Manual drawing of gleba polygons on the map
  • Creation of polygons via GPS track
  • Import of KML files for gleba creation
  • Automatic area calculation of created polygons
  • Data export in XLSX and KML formats
  • Local storage of mapping data

17.2 Use of Geolocation

  • Access to GPS location only when the user activates the feature
  • Collection of coordinates for polygon creation and validation
  • Track tracking for automatic area delimitation
  • Location permissions are requested only when necessary

17.3 Storage and Privacy

  • ALL mapping data is stored LOCALLY on the device
  • GPS coordinates are not transmitted to external servers
  • Polygons and metadata remain exclusively on the user's device
  • Export files are generated locally
  • Simule Agro DOES NOT access, collect, transmit, or store on external servers any data entered by the user in the gleba mapping feature.
  • User has total control over their mapping data

17.4 Limitations and Responsibilities

  • Simule Agro is NOT responsible for loss, corruption, unavailability, or recovery of data in case of: (i) device exchange; (ii) loss, theft, or device damage; (iii) app uninstallation; (iv) app data clearing; (v) operating system update; (vi) hardware failures; (vii) data corruption; (viii) factory reset; or (ix) any other event resulting in local data loss
  • Coordinate accuracy depends on GPS signal quality
  • Area measurements are approximate and do not replace technical surveys
  • User is responsible for the accuracy of entered data
  • Mapping feature is completely optional

18. Rural Harvest Management

Simule Agro offers rural management functionality allowing the user to register and track harvests, plots, costs, revenues, agricultural activities, and performance indicators (KPIs).

Rural management features are exclusively organizational and informational, serving as an auxiliary tool for the rural producer in controlling and planning activities. Registered information and calculated indicators DO NOT replace accounting, financial, agronomic, or any other professional advice.

18.1 Local Storage and Data Privacy

  • ALL rural management data is stored EXCLUSIVELY LOCALLY on the user's device
  • Simule Agro DOES NOT access, collect, transmit, or store on external servers any data entered by the user in rural management features
  • Harvest, cost, revenue, activity, and other information remain under the user's total and sole control
  • Simule Agro does not perform backup, synchronization, or any type of remote storage of this data

18.2 User Responsibility and Limitations

  • The user is ENTIRELY responsible for the safekeeping, protection, and backup of their rural management data
  • Simule Agro is NOT responsible for loss, corruption, unavailability, or recovery of data in case of: (i) device exchange; (ii) loss, theft, or device damage; (iii) app uninstallation; (iv) app data clearing; (v) operating system update; (vi) hardware failures; (vii) data corruption; (viii) factory reset; or (ix) any other event resulting in local data loss
  • XLSX report export functionality is available for the user to make external backups of their data when deemed necessary
  • It is strongly recommended that the user performs periodic data exports as a security measure

18.3 Available Features

  • Registration and management of harvests by plot
  • Cost registration by category (pesticides, fertilizers, seeds, labor, etc.)
  • Revenue registration (sales, production, etc.)
  • Agricultural activity registration (planting, harvesting, applications, etc.)
  • Automatic indicator calculation (total cost, gross margin, break-even point, etc.)
  • Report export in XLSX format
  • Integration with previously created plot/gleba registry

18.4 Limitations and Disclaimer

  • Calculations and indicators generated are based exclusively on data provided by the user
  • Result accuracy depends entirely on the quality and veracity of entered data
  • Information and indicators do not constitute professional advice of any nature
  • Simule Agro is not responsible for decisions made based on generated data and indicators
  • There is no guarantee of continuous feature availability
  • Features may be changed, removed, or discontinued without prior notice

19. Optional Integration with Google Calendar

The app offers a free and optional feature to synchronize agricultural activities with Google Calendar.

The service is provided "as is." Simule Agro does not guarantee that synchronization will be uninterrupted, error-free, or that events will always be updated instantly, depending on Google API availability and user connectivity.

Simule Agro is exempt from any liability for: (i) failures in creating events or reminders; (ii) duplicate information in the calendar; (iii) missed agricultural deadlines due to reliance on automatic notification; or (iv) any loss caused by Google service unavailability.

We recommend that the user always check their calendar and configure redundant alerts for critical activities.

20. Verification in Official Sources

The user acknowledges and agrees that, by accepting these Terms of Use, they undertake to always verify official means and primary sources to certify the veracity, timeliness, and accuracy of information before making any decision based on data displayed by the app.

All Simule Agro features are merely informational and educational, not replacing consultation with official sources, specialized professionals, or competent bodies when necessary.

21. Intellectual Property and Licensing

All rights relating to the software, its brands, logos, interfaces, and content are owned by Simule Agro or third-party licensors, and their use without express authorization is prohibited.

The Simule Agro license is personal, revocable, limited, non-exclusive, non-transferable, and non-sublicensable, strictly for personal use on devices you own or control, in accordance with the applicable store rules (Google Play and/or App Store).

Distribution, resale, modification, reverse engineering, decompilation, or commercial exploitation of the software by third parties is prohibited without express authorization from Simule Agro.

22. Upload of Logos and Third-Party Content

By sending logos or images for reports, you declare you own usage rights over the material. Sending content that violates copyrights, trademarks, or is illegal is prohibited.

Images are validated for format and size and used only to compose reports generated for you. Simule Agro is not responsible for disputes arising from misuse of third-party trademarks.

23. Minimum Age

The app is intended for people 18 years or older. By using the app, you declare to be of legal age. If use by a minor is identified, the account may be closed and data deleted.

24. Acceptance of Terms

Use of the software implies knowledge and full acceptance of these Terms of Use (EULA). If the user does not agree, they must immediately stop using the software.

You may request account deletion directly in the app. If an auto-renewing subscription is active, cancellation must first be done in the store (Google Play and/or App Store); after that, account deletion removes data as described in the Privacy Policy and may immediately terminate premium benefits linked to the account.

25. Forum and Applicable Law

This Term is governed by Brazilian law. The elected venue for any disputes is the city of Alegre, in the state of Espirito Santo, Brazil, ZIP Code 29.500-000, except where specific consumer protection law provides otherwise.

26. AgroMind — Artificial Intelligence Assistant

AgroMind is an assistive and informational tool integrated into the Simule Agro Premium plan. Its responses are generated by artificial intelligence models and do not replace guidance from an agronomist, agricultural engineer, financial advisor, lawyer, accountant, safety technician, or any competent regulatory authority.

AgroMind responses may contain inaccuracies, omissions, or outdated information. The user must always validate recommendations obtained through AI before executing planting, input application, purchasing, financing, management, spraying, or any decision with economic, environmental, or regulatory impact.

For pesticides, prescriptions, dosage, safety intervals, withholding periods, use by crop/pest, and legal compliance, the product label, official registration, qualified technical guidance, and applicable local rules always prevail, even when AgroMind uses official third-party data sources as informational support.

Availability and operational limitations

  • AgroMind may be temporarily unavailable due to maintenance, AI provider instability, network latency, or quota limits;
  • There is no guarantee of uninterrupted continuity, response time, or availability of specific features;
  • The AI model used may be changed without prior notice to improve quality, performance, or cost;
  • Features based on external data, including region-specific official agricultural integrations, quotes, and web search, depend on the availability, technical limitations, and rules of those providers.

Usage quota and limits

  • The Premium plan includes a quota of 250 messages per monthly subscription cycle;
  • Operational limit of 30 messages per hour, per user;
  • Only actual calls to the AI endpoint count toward quota; local actions, card confirmations, navigation, and exports do not consume quota;
  • Upon reaching 100% of the quota, sending new messages is blocked until the next cycle, but access to history remains available.

Prohibited use

  • Sending illegal, offensive, discriminatory prompts or those that violate third-party rights;
  • Attempting to extract system secrets, manipulate responses through prompt injection, or exploit vulnerabilities;
  • Automating message sending (scraping, bots) or making abusive use of the service;
  • Using AgroMind for purposes contrary to Brazilian or US law.

Anti-abuse measures

Simule Agro may apply technical limitations, usage pattern monitoring, fraud mitigation, and temporary or permanent blocks to AgroMind access when use outside agreed terms is identified.

Limitation of liability

To the maximum extent permitted by applicable law, Simule Agro is not responsible for decisions made based on AgroMind responses, for direct or indirect damages arising from inaccuracies, omissions, or AI unavailability, or for losses associated with actions taken without validation from official sources and qualified professionals.

iOS Annex - App Store (Apple) Specific Terms

For the iOS version distributed via the App Store, this EULA is concluded between you and Simule Agro, and not with Apple Inc. Simule Agro is solely responsible for the app and its content.

Apple has no obligation to provide maintenance or support services for the app.

To the maximum extent permitted by law, Apple provides no warranty regarding the app. If the app fails to conform to any applicable warranty, you may notify Apple and, where applicable, request a refund of the purchase price paid for the app license.

Any user or third-party claims related to the app (including product liability, legal/regulatory compliance, and consumer protection claims) are Simule Agro's responsibility, not Apple's.

In the event of any third-party intellectual property infringement claim related to the app, Simule Agro will be solely responsible for investigating, defending, settling, and resolving the claim as required by law.

You represent that you are not located in a U.S.-embargoed country and are not listed on any U.S. Government restricted party list. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
